After 38 days in detention, the court has decided to release Tal Yinon Dardik, who is suspected of abusing a Palestinian Arab, without any restrictive conditions. Judge Amir Shaked accepted the request submitted by the Honenu organization and ordered Dardik's release from detention.
Attorney Nati Rom welcomed the decision. “We have just received the decision of the honorable Judge Amir Shaked to immediately release Tal Yinon Dardik without any conditions whatsoever. We are pleased that the defense’s arguments from the very beginning were accepted. This order is unenforceable; the general issued the order without authority. The order is therefore effectively nullified, and consequently there was no violation and no justification for his detention. We are pleased that he is being released and hope that this time the judicial decisions will be respected and that he will be able to rehabilitate himself and his family."
Attorney Moshe Polsky added: “We welcome the court’s decision ordering his release without any conditions. This was called for. In our opinion, he should have been released nearly two months ago. We already said that the administrative order issued against him was not worth the paper it was written on, because there was no legal possibility of implementing it. The state dragged Tal Yinon into unnecessary legal proceedings, including enormous expenditures at the taxpayers’ expense. It was clear to everyone that this would be the outcome - that Tal Yinon would be released home without any conditions, because no offense can be attributed to him."
The Honenu organization stated: “The administrative order against Tal Yinon Dardik, like those against dozens of others like him, is a black flag over the commanding general and those overseeing him. The general and the Defense Ministry must put an end to the use of administrative orders that are used only against settlers - not against crime bosses and not against any other citizen in the State of Israel. Nor does this happen anywhere else in the free world. The only population in Israel persecuted through administrative orders is the settlers of Judea and Samaria. We call on the general: Cancel all the orders against the settlers today."
