The Army originally sentenced Pilent to 28 days in jail, but the High Court ordered a retrial after accepting his claim that his rights were violated during the trial. The army announced he will be retried Sunday.
The American-born Pilent was on leave of absence from the army when his own unit and other defense forces confronted his community of Givat Lehava in Samaria and destroyed two empty trailer homes. Pilent pleaded with the soldiers not to destroy the homes and was arrested for insubordination.
"It hurts me to have to struggle with my friends, to stand against them and not with them, but there was no choice," he said after the incident. Destroying a Jewish home takes a part out of me."
Pilent has become a symbol for opponents to the government's plant to destroy all the homes of 8,000 Jews in northern Samarian and Gaza and force the residents to move elsewhere.
He said that he is calling for Mofaz to appear as a witness in the retrial, as well as the head of the Central Command and the Samaria division, to testify in his retrial.
