Regavim, the movement for safeguarding national land, has petitioned the High Court of Justice against the Defense Minister in a demand to raze an Arab village near Haresha in the Binyamin area of Samaria.

The motion was first filed in 2006 but was rejected on the grounds that the state “acts to enforce the law based on its own priorities.” The decision to make a renewed attempt at having the petition accepted was made after Supreme Court President Dorit Beinisch determined a new judicial approach, according to which the state must give a schedule for demolition even if it does not immediately proceed to demolish.

The original motion was filed against four permanent structures located in Mazraat al Kabaliya which were built illegally and without construction permits.

The attorney for Regavim, Doron Nir, wrote in the motion that the four structures are just one detail in “a sad general picture of conscious and intentional non-enforcement against illegal construction by Palestinians in all of the 'C' areas in Judea and Samaria.” C areas are areas under Israeli administrative and security control, as defined by the Oslo accords. 

The Ministry of Defense acknowledged that the structures are illegal and that as such, they are slated for destruction.
