The Jerusalem Magistrate's Court has ruled that the compensation and rights of a combat victim from the Yom Kippur War would be paid to him retroactively from the close to the war to this day - because his mental state did not allow him to file a claim.
Only 30 years after the end of the war did one of his acquaintances learn that although his world treated him as a combat victim, he never contacted the Defense Ministry to recognize his disability. The Defense Ministry's compensation officer ruled that the plaintiff suffered from post-traumatic stress disorder as a result of his military service and ruled 50-percent permanent disability benefits from the date of filing the claim. The plaintiff's lawyer appealed, citing a procedure anchored in the law, since the plaintiff's mental state from the time of his release from the army did not enable him to handle his case.
