Lawyers: Forced Arbitration may be Unconstitutional

The Israel Bar Association expressed opposition Tuesday to a Justice Ministry initiative that would require many civil financial suits to be brought to arbitration. Under the proposed law, suits involving sums up to 2.5 million shekels would go to mandatory arbitration with a private lawyer.

IBA leaders said they agree that arbitration should be strongly encouraged. However, they warned, “The Justice Ministry’s proposal will not relieve the overload in the court system, and will create serious problems from a constitutional perspective.”
