Judge Yossi Torres of the Hadera Small Claims Court ordered the Cellcom cellular telephone company, Thursday, to pay a customer 2,100 shekels plus 400 shekels in court costs for sending the customer three promotional SMS messages and did not honor the customer's request not to receive them, in violation of the communications law.
The case was brought about by an employee of the Yediot Acharonot daily who was given a phone for work. Cellcom claimed that only Yediot could make the request not to receive promotional SMS messages. In his ruling, Judge Torres disagreed, saying that the person who was in physical possession of the phone could make the request. He also cited Cellcom as the provider of the service and the company being advertised in the messages.
