High Court: Foreign Workers Can Stay After Birth

The High Court has canceled an Interior Ministry policy under which female foreign workers who gave birth were deported three months later. Judge Ayala Procaccia stated that the policy was not within the bounds of proportionality and reason.

Several left-wing organizations, among them Kav Laoved and the Association for Civil Rights, had filed suit against the policy, saying workers should be allowed to remain in Israel until their permits expire regardless of whether or not they give birth in that time.

Many workers who have given birth in Israel have later argued against deportation when their visas expire, saying it is inhumane to expel children born in Israel from the country. Thousands of foreign workers, illegal entrants, and their children have been allowed to remain in Israel due to such arguments.
