The High Court Wednesday overruled a Jerusalem court decision and stated that that the Palestinian Authority (PA) is not a sovereign entity and can be sued by Israelis. The ruling accepted an appeal by the Beit Midrash of Elon Moreh, which unsuccessfully tried to file a suit in 2006, when the Jerusalem District court ruled that the PA held immunity.
The suit involved false testimony by Arabs in Samaria concerning land ownership. The Elon Moreh group won the lawsuit in a Tel Aviv court, but the verdict was ignored and the financial claim never was paid. In a suit against the PA for payment in the Jerusalem court, the judge ruled that the PA was a sovereign entity and could not be sued.
