Shabbat Desecrating

Shabbat desecration is on the rise in Jerusalem.

Sadly one week ago yet another restaurant opened in the heart of Jerusalem on Gaza Street and more restaurants are opened in the center of town publically desecrating the holy day.

What is equally shocking is that the local ordinances passed by the Jerusalem City Council to minimize the desecration of Shabbat are ignored by both the Shabbat desecrating restaurants and the city itself.

The Jerusalem law regarding restaurants has 3 limitations in order to somewhat preserve the sanctity of the Shabbat day.

  • Restaurants opened on Shabbat are forbidden to serve customers in outdoor seating areas.
  • Restaurants opened on Shabbat are forbidden from playing music
  • Restaurants opened on Shabbat must close by 10pm on Friday night and close between 3pm and 6pm on Shabbat afternoon or until what ever time Shabbat goes out before 6pm.

The way forward in combating this form of Shabbat desecration is by ensuring that the laws already in place are respected and upheld.

The law reads:

On rest days, except for Yom Kippur and the night of Tisha Ba'av, a person may not open nor is permitted to open a Restaurant:

1. Serve food with entertainment and music 

2. Close between 10pm and 9am and between 3pm and either 6pm or the end of the day or rest, whichever comes first. 

3. During permitted hours of operation, a person will not serve or permitted to sell food or drink outside of the walls of the Restaurant whether through a window or any other manner outside or to the outside. 

Violation and punishment:

One who violates the provisions of this law is liable to pay a 600 NIS fine.

Law takes effect 17.4.1988 

(ג) בימי מנוחה, למעט יום הכיפורים וליל תשעה באב, לא יפתח אדם ולא ירשה לפתוח בית אוכל -
(1) שמוגשים בו אוכל או משקה בליווי שעשועים, נגינה וכיוצא באלה;
(2) שלא פורש בפסקה (1) - בשעות שבין 22 לבין 9, ובשעות שבין 15 לבין הזמן המוקדם משנים אלה : שעה 18 או סוף יום המנוחה, ובלבד שבשעות שפתיחת בית האוכל מותרת, לא ימכור אדם ולא יגיש ולא ירשה למכור או להגיש אוכל ומשקה אלא בתוך כתלי בית האוכל ולא דרך חלון או באורח אחר בחוץ או  אל החוץ.
