Lawyers for James Holmes, who killed 12 people in a Colorado movie theater, have made the argument in court that their client is mentally ill. Attorneys were arguing over disclosure of information in the case.

Defense attorney Daniel King argued that the defense team “cannot begin to assess the nature and depth of Mr Holmes’ mental illness” until receiving more information from the prosecution and investigators.

Prosecutors argued that disclosing information at this stage could put the investigation at risk.

Media organizations have asked for more information as well, calling to remove a gag order that bars Holmes’ university from revealing details about him. Holmes, 24, was formerly a Ph.D. student at the University of Colorado.

He entered a movie theater in Aurora, Colorado on July 20 and began shooting, murdering 12 people and wounding another 58. He is charged with multiple counts of first-degree murder and attempted first-degree murder.

Holmes had also rigged his apartment with bombs designed to kill anyone who entered.
