PA Arab workers will receive benefits that Israeli workers in the public sector may not benefit from, because of a legal loophole.

Calcalist newspaper reported that although since 2001 new employees in the public sector have not received a budgetary pension, due to a breach in the law some 100 Palestinian Authority Arabs who work in the Civil Administration will benefit from it.

Employees hired in the public sector since 2001 no longer receive a budgetary pension, but rather a cumulative pension. Together with the employer, employees set money aside every month for their pension savings.

However, according to the report, PA Arabs working in the Civil Administration in Judea and Samaria and considered public sector employees, because of their status as Palestinians, are subject to Jordanian law and orders of the OC Central Command, in which the budgetary pension was not canceled.

This creates a situation in which Israeli public sector workers do not receive a budgetary pension while their PA Arab counterparts in the Civil Administration do.

The Finance Ministry tried for a time to insist on not providing this benefit, but after a long saga they folded.

The Civil Administration's Coordinator of Activities in the Territories told the newspaper "the salaries and conditions are paid to Civil Administration employees according to the law that applies in Judea and Samaria."

No response has been received from the Finance Ministry.
