AddReply(322112,"SK must be kidding (about menopause) -- and other musings","YG","Greater DC","07/10/08","Come on Man -- how many Jewish couples do you know, frum or otherwise, who in their 50s or 60s, get divorced -- or for that matter, stay married and live like \"brother and sister\" -- to avoid having relations after she goes thru \"the change\"??\n\nIn fact, most frum couples I\'m aware of LONG for those years, when taharat mishpacha will no longer restrict their marital adventures to 2 weeks or so out of every month.\n\nYes, after menopause, yes during pregnancy, yes for couples in which one or both partners are infertile, and, depending on which Rav is consulted, yes even for \"regular\" couples using permitted * types of birth control, if the situation warrants a heter (again, a Rav must be consulted and, generally, low income is NOT a valid rationale for BC but other types of difficult situations may well be).\n\nOf course, you would know none of this if Mr. Fishman continues to print comments like # 11 to be printed unchallenged:\n\n\"Certainly c#nd#ms are forbidden\nS*m*n contains living souls. It is both the spiritual and genetic basis of life. It is forbidden to waste it. That\'s why m@sturb@tion and the other things listed are such serious transgressions.\"\n\nIf we are talking about living souls, the implication would certainly seem to be: no relations for any purpose or under any circumstance whatsoever, when procreation is impossible, and that\'s just not what the halacha says.\n\nBesides, talk about a minefield!! If every emission contains even a thousand sperm cells (and I believe the actual # is closer to a million), then even when coitus DOES result in a pregnancy, 999 living souls are presumably being exterminated during the act (though I suppose with enough luck, quintuplets could be conceived, bringing that down to a mere 995). In fact, what about the myriads of sperm cells that are lost simply by dying off inside a man\'s body without ever being ejaculated? Perhaps merely refraining from coitus amounts to killing living souls? Maybe we all need to dedicate ourselves to round-the-clock marital relations so that we do not get accused of murder!\n\nProbably my main point here is the phrase above (and below) about CONSULTING A RAV. The author of this blog (and to my knowledge the entire js website) is MR, not Rabbi, Fishman. He may have a Rabbinic authority that he consults with when writing, but that is HIS authority, not mine, nor one who necessarily owns the allegiance of the entire frum world, or anywhere near it.\n\nIt\'s fine to cite kabalistic positions on this subject, IF accompanied by sufficient, clear disclosures that they are, well, KABBALISTIC, rather than normative-halachic, positions. Many folks out there just want to know what the basic Din is, and the truth is, those folks REALLY need to go somewhere else to get it -- and \"links\", from the previous blog, was basically correct after all:\n\n\"It seems to me that most of the material on the js website is intended for Torah scholars and people who aspire to be holy tzaddikim, and not for the average Jew.\"\n\nI have a problem when behaviors that are clear issurim from the Torah -- adultery, incest, bestiality, relations with nidah, and (sorry, SK, but it is pretty clear) homosexuality ** -- are listed together with rabbinically derived issurim and behaviors of a far fuzzier nature, as if they are all the same thing.\n\nFor example, fantasies --about any of the above behaviors --are NOT the same thing as carrying out the behaviors. Relations which are \"lo k\'dar\'cha\" are NOT AT ALL clear-cut issurim, rather, Rambam (somewhere in Hilchot Issurei Biah, I\'m no expert) considers them within the Din (I don\'t know if it\'s even clear whether that excludes the climax), just not recommended. Relations only in the dark -- not even sure where that comes from, perhaps the story with Yaakov and Leah implies it (he did not know who he had been with, until the morning), but then again, Yitzhak and Rivka are observed \"m\'tzahek\" from a window, and how does THAT happen if there is no light? (Moreover, if lo k\'darcha is within the Din, one would kind of think relations in the light would come along by Kal V\'Homer.)\n\nIn fact, of the 5 categories of clear Issurei Torah I listed above, 2 didn’t even make it onto Mr. Fishman’s list, and it is troubling if such basic issurim were overlooked because of a need to pad the list with less clear-cut issues.\n\nIn conclusion, I would recommend a scholarly, well-researched source such as R. David Feldman’s book “Marital Relations, Abortion and Birth Control in Jewish Law”, be read carefully and digested, before venturing anywhere near a website like js. Look into a Kabalistic approach, by all means, if it interests you or you will find it helpful – just make sure you are well-grounded in basic halacha before doing so.\n\n\n* I believe that # 11 GENERALLY got it right about condoms being a problematic form of BC (even here, there may be some exceptional situations, esp in-vitro fertilization, and a Rav needs to be consulted). Then again, BC that is sanctioned (in situations where a Rav grants a heter) includes use of a diaphragm and, as far as I know, this includes using the spermicide without which the device is far less effective. Not exactly supportive of an argument about killing off living souls.\n\n** Since halacha is basically action-based, the sinner and the sin can generally be dealt with separately. Specifically, I do not see “being gay”, meaning being attracted to the same gender, as an issur, and while each individual act of sodomy is indeed a violation of halacha, that is a far cry from taking SK to task, as do the likes of Har Nof Michael, for, absurdly, being in some perpetual state of sin. Give it a rest, Michael  – you have no idea whether SK is holding onto the sheretz or trying in some way to get rid of it, he is not on here to talk up his homosexual proclivity, no one is trying to be “m’taher” him from that proclivity, and it’s frankly ridiculous to keep asserting that that proclivity somehow disqualifies him from articulating valid, useful observations and opinions about EY and critical life-death issues facing the Jewish people. If Tsvi somehow succeeds in placing \'eyeguards\' on adolescent Jewish kids, boys and girls, around the world, he may succeed in bringing about the anti-Semites fondest \'fantasies\' about our future. While I agree that porn addictions are no good, especially for adults, and distract from honoring the opposite sex and pursuing relationships, fantasies are just normal. \n\nTsvi, I really think you would feel at home in Kandahar or in the tribal territories of northwestern Pakistan.\n\nThis is Judaism?");

You have alluded before that it\'s our fault you fantasize, our fault you rape, our fault the world is in moral decay, our fault we have terror attacks and our fault Israel has little water.\n\nMy dear little brother Tzvi, you act just like Adam in the garden of Eden. When G-d asks Adam why he sinned (ate from the forbidden fruit) he doesn\'t take responsibility and say, \'Yes, L-rd, I sinned. I am sorry. I should not have done that and I fall with my face to the ground in repentance.\' Instead, he (and I appreciate Adam, but am using this only to make a mussar point) he instead BLAMES EVE and even blames HASHEM for his action of eating the fruit. he states,,,\n\"The woman whom YOU gave to be with me,,, SHE gave me of the tree and I ate.\"\n\nI expect more from you Tzvi. Adam was not a Jew, you are. You are even claiming or striving to be a holy Jew. So act like a holy person would.\n\nTzvi,\nyou obviously have sexual hang ups.
