Soldier Elor Azariya submitted today a request to the military court of appeals to be released from his open imprisonment on the Nachshonim military base starting on July 20, the date of his original release date from the IDF, according to Channel 20.
According to the report, assuming the court of appeals doesn’t reach a decision by that date on the matter of the appeal submitted by both sides, the judges will need to decide what Azariya’s fate will be until a decision is reached.
Since the court ruled that Azariya is not to be sent to jail pending a decision, the court has two options: release Azariya until a decision is made, or release him under limiting conditions, such as house arrest.
Attorney Yoram Sheftel, representing Azariya during the appeal, said, “I intend to request from the court at most house arrest from midnight to 6 in the morning - if at all.”
The significance of such a release is that, for the first time since the shooting incident in Hevron last year, Azariya would be able to return to an almost fully normal routine until a decision is made.
The request, submitted today, Wednesday, will also be passed to the attention of the prosecution, which will have to disclose its position at a hearing to be held by the 20th of the month.
If the prosecution opposes the request, the judges will set a court hearing, and will meet an additional time before the ruling expected to be given during the month of August.
