Bill Aims to End Discouragement for Divorced Fathers

A new bill modifying the Tender Years Clause is likely to pass into law after being unanimously supported by the Ministerial Committee for Legislation. Proposed by Justice Minister Tzipi Livni (Hatnua) the bill will adjust automatic custody of children from under six-years-old to under two-years-old for separated or divorced mothers.

The Schnitt Committee found the law was unfair and discouraged adequate time with the father in addition to the child support required by all non-custodial parents. A recent report indicated that Israel has one of the highest rates of child support payments in the world. Another recent study showed that Israel has one of the highest rates of using social worker-run visitation centers as opposed to a more natural setting.

MK Gila Gamliel (Likud - Beteynu) stated this weekend, “it is important that children have a relationship with both their parents."
